Welcome to the website of Kage Design Media (“we”, “us”, “our”). We are a sole trader business trading under the name Kage Design Media registered in South Australia. By accessing this website or enquiring about our services, you agree to be bound by these Terms and Conditions.

 

1. About Our Services
   
   Kage Design Media provides creative services including graphic design, branding, and digital marketing.

   
   Custom Packages: We do not sell services directly via this website. All services are tailored to the client following a consultation.
   
   Prepaid Model: Our standard model operates on prepaid hourly "packages." Specific terms regarding your package will be outlined in a separate Services Agreement provided to you before payment.
    

2. Website Use & Intellectual Property
   
   Content Ownership: All text, images, graphics, and portfolio work on this website are the intellectual property of Kage Design Media. You may not copy, reproduce, or "scrape" content for commercial use without our express written consent
   
   Accuracy: While we strive for accuracy, website content is provided for general informational purposes and may be updated at any time without notice.
    

3. Prepaid Hours (Standard Terms)
   
   While your individual Services Agreement will take precedence, our standard terms for prepaid packages are:
   
   Payment: Full payment is required via bank transfer before work commences.
   
   Validity: Prepaid hours are valid for twelve (12) months from the date of purchase.
   
   Expiry: Unused hours expire after 12 months. We will provide a courtesy reminder 30 days before expiration.
   
   Non-Transferable: Hours are tied to the purchasing entity and cannot be transferred or sold.
    

4. Revisions & Creative Process
   
   Hourly Deduction: We offer flexibility in revisions; however, all time spent on changes, refinements, or communication is deducted from your prepaid hour balance.
   
   Subjective Nature: Creative work is subjective. While we apply professional skill and care, we do not guarantee "subjective satisfaction" or specific commercial performance (e.g., a specific number of sales from an ad).
    

5. Refund Policy & Australian Consumer Law (ACL)
   
   ACL Guarantees: Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a remedy for a "major failure" of service.
   
   No Change of Mind: To the extent permitted by law, we do not offer refunds for "change of mind," personal stylistic preference, or if your business requirements change after work has begun.
    

6. Client Responsibilities
   To ensure your hours are used efficiently, you agree to:
   - Provide a clear and timely brief.
   - Supply necessary assets (logos, high-res images, copy).
   - Access and monitor the shared Google Drive folder provided for your project.
   
   Note: Delays caused by a lack of client feedback may result in project stagnation, but do not pause the 12-month expiry period of your hours.
    

7. Limitation of Liability
   To the maximum extent permitted by law, Kage Design Media’s total liability for any claim is limited to the amount paid for the services in question. We are not liable for any indirect loss, loss of profit, or "greenwashing" claims resulting from client-provided information.
    

8. Governing Law
   These Terms are governed by the laws of South Australia. Any disputes shall be resolved in the courts of South Australia.
